2. PURPOSE

The personal data referred to in this privacy policy are the identification and contact information requested by Baqueira for the purposes described below such as name and surname, national identity card or equivalent document number, date of birth, affiliation in some cases, postal address, physical data (height, weight), sex, skiing level, telephone number, email address and photograph.

With respect to the product, service or activity hired or used or other cases of voluntary provision of your data, they may be processed for the following purposes:

  • 2.1. When purchasing/using a ski pass or ticket for transport by cableways, reloadable ski pass and BaqueiraPass, hereinafter ski passes, or asking for information about them.
  • 2.2. When hiring or gathering information to make bookings with Viajes Baqueira Beret, SA.
  • 2.3. When hiring or asking for information about booking Hotel Montarto / Apartarent accommodation.
  • 2.4. When hiring or asking for information about rental, sale and repair of ski equipment. (Ski Service).
  • 2.5. When hiring or asking for a Wi-Fi Service connection.
  • 2.6. When taking part in presentations, competitions, races and in general any sports, promotional, recreational or other events promoted by Baqueira, or asking for information about them.

2.1. When purchasing/using or asking for information about a ski pass or ticket for transport by cableways, reloadable ski pass and BaqueiraPass, hereinafter ski passes.

  • Access control to facilities and services through reading by RFID systems for flow control and usage statistics; this control may entail capturing images of skiers.
  • Managing the purchase of products and/or the provision of services hired by you and those required for their provision; for this purpose you specifically acknowledge and accept that your data may be disclosed to third-party companies outside the Baqueira group when such companies provide the requested service.
  • Managing your registration as a platform user. The personal data you provide will be processed to identify you as a platform user and give you access to its features, products and services which are available to you as a registered user.
  • Likewise your data may be used by the BAQUEIRA BERET group, hereinafter BAQUEIRA, to send you information regularly or occasionally and by any medium, including post, email and mobile phone, and whether personalised or not, about events, news, promotions, products, activities and services of the Baqueira group or of third-party Baqueira partner companies and also to manage your participation in all kinds of events, contests or promotions run by Baqueira or its third-party partner companies.
  • Profiling to personalise the range of services and advertising.
  • Handling the assistance and rescue service on the runs if need be.
  • Handling if applicable your participation in events, promotions, competitions, races and any other sports, advertising, recreational or other events promoted by Baqueira.
  • Using other products, services and activities offered by Baqueira may lead to fresh data gathering and processing, so we recommend you read the purposes of such processing as specified herein before taking them out.

Payment by bank card for services contracted online is automated through a computer application called a payment gateway.     In addition the bank cannot find out the items purchased, the shipping address or other personal data of the customer which are not relevant for payment, and Baqueira does not know and does not have access to their bank details.

2.2. When hiring or gathering information to make bookings with Viajes Baqueira Beret, SA, your data will be processed for the purpose of:

  • Managing your accommodation reservations; for this purpose you specifically acknowledge and accept that your data may be disclosed to the owners of hotels and other hospitality establishments, whether or not they are in the Baqueira group, which are to provide the accommodation service you have asked for.
  • Managing the purchase of products and/or the provision of services hired by you and those required for their provision, by way of example but not limitation a ski pass or BaqueiraPass, ski rental, ski lessons, rental of parking spaces, paying for time in children’s snow parks, events and competitions, etc.; for this purpose you specifically acknowledge and accept that your data may be disclosed to third-party companies outside the Baqueira group when such companies provide the service you have hired.
  • Disclosing data to the public authorities in compliance with legal requirements.
  • Managing your registration as a platform user. The personal data you provide will be processed to identify you as a platform user and give you access to its features, products and services which are available to you as a registered user.

  • Managing the purchase of products and/or the provision of services hired by you and those required for their provision. Your personal information such as shoe size, weight and skiing level are essential for the adjustment of the equipment.
  • Disclosing data to the public authorities in compliance with legal requirements.
  • Likewise your contact details may be used by the BAQUEIRA BERET group, hereinafter BAQUEIRA, to send you information regularly or occasionally and by any medium, including post, email and mobile phone, and whether personalised or not, about events, news, promotions, products, activities and services of the Baqueira group or of third-party Baqueira partner companies and also to manage your participation in all kinds of events, contests or promotions run by Baqueira or its third-party partner companies.
  • Profiling to personalise the range of services and advertising.
  • For statistical purposes and studying operational flows.

2.5. Wi-Fi connection service.

  • Offering you the Wi-Fi connection service.
  • Your email address may be used by the BAQUEIRA BERET group to send you information regularly or occasionally about events, news, promotions, products, activities and services of the Baqueira group or of third-party Baqueira partner companies.

2.6. Taking part in presentations, competitions, races and in general any sports, promotional, recreational or other events promoted by Baqueira, or asking for information about them.

  • Likewise your data may be used by the BAQUEIRA BERET group, hereinafter BAQUEIRA, to send you information regularly or occasionally and by any medium, including post, email and mobile phone, and whether personalised or not, about events, news, promotions, products, activities and services of the Baqueira group or of third-party Baqueira partner companies and also to manage your participation in all kinds of events, contests or promotions run by Baqueira or its third-party partner companies.
  • Profiling to personalise the range of services and advertising.
  • For statistical purposes and studying operational flows.
  • Entrants in competitions promoted by Baqueira in which photos are requested accept that Baqueira Beret SA may retain and use the photos supplied for advertising and/or promotional purposes in or on websites, social media, mailings, videos, magazines or any other physical or online medium it considers appropriate in its current and future messages and/or promotions.
  • The winners of promotions, contests and/or competitions accept that their name will be published on Baqueira’s website and social media and also on Radio Aran (91.0 FM).

2.7. CCTV cameras and access control to facilities.

  • Photos and footage will be captured for security purposes and control of access to facilities by image-based identity verification. The places where image capture and/or recording cameras are installed will be announced through information signs.

2.8. Capturing vehicles, images and number plates of vehicles in car parks.

  • In order to manage the parking and security service.

2.9. Capturing and using photographic images and footage whether ours or provided by our users.

  • They may be used for promotional and advertising purposes and for this purpose inserted in any kind of physical or online medium, including by way of example but not limitation magazines, brochures, websites, social media, etc.

2.10. Baqueira Beret app.

  • The Baqueira app may ask to send push notifications in order to convey messages of interest through your mobile phone. You will only receive them if you accept this request.
  • The app may ask for your location in order to offer you more personalised information and services. This tracking will only take effect if you accept the request which appears on your mobile phone.

2.11. Weekly short course.

  • Managing your participation in the short course and subsequent race.
  • Contacting the winners for the Gold Test, the competition at the end of the season for all weekly winners.
  • Likewise your data may be used by the BAQUEIRA BERET group, hereinafter BAQUEIRA, to send you information regularly or occasionally and by any medium, including post, email and mobile phone, and whether personalised or not, about events, news, promotions, products, activities and services of the Baqueira group or of third-party Baqueira partner companies and also to manage your participation in all kinds of events, contests or promotions run by Baqueira or its third-party partner companies.
  • Profiling to personalise the range of services and advertising.
  • For statistical purposes and studying operational flows.

2.12. Complaints and suggestions.

  • Handling your complaint and the contacts required to resolve it. If your complaint is about a third party which is the service provider, this may mean that your data will be released for direct and effective resolution of the issue.
  • Making a record of your suggestions and possible clarifying contacts.
  • Statistical and study purposes to improve our services.

2.13. Information request.

  • Handling your enquiry in order to answer it.
  • Statistical and study purposes to improve our services.

2.14. Accident reports.

  • Procedures required for handling the accident and treating the injured person.

2.15. Job applications.

  • Handling such applications in staff selection processes to meet Baqueira’s hiring needs. CVs received are destroyed each year at the end of the winter season.
  • Your express prior consent will be requested for specific purposes that are not included in those described in this section.

3. LAWFUL BASIS

Personal data processing is based on the prior consent of the interested party.
If you do not agree to provide your data or allow them to be processed in the terms established in this Privacy Policy, Baqueira Beret will be unable to provide the services or supply the products and will have to reject your participation in various actions such as promotions, races and other events described in the previous paragraph.

You warrant that the data you provide are true and accurate and Baqueira reserves the right to ask you to show official documents accrediting the data you supply.

Personal data of minors

Children under 14 will not be able to provide their personal data by themselves and for this purpose will need the consent of the people who have their legal custody or guardianship.

Third-party personal data

Although in principle data must be provided directly by the interested parties, when products or services are contracted on behalf of third parties and their personal data have to be provided, the provider must have the prior, informed and express consent of such third parties for the transfer of their data to Baqueira and the acceptance of this Privacy Policy and expressly with respect to the purposes indicated above.

4. LINKS

As a service for our visitors, our websites may include hyperlinks to other sites that are not operated or controlled by the Baqueira Group. Consequently the Baqueira Group does not warrant and nor is it liable for the legality, reliability, usefulness, veracity and timeliness of the contents of such websites or their privacy practices. Before providing your personal information to these non-Baqueira websites, please note that their privacy practices may differ from ours.

5. RECIPIENTS

Baqueira will not transfer any personal data supplied to third-party companies outside the Baqueira Group other than in the cases described in this Privacy Policy, and there are no recipients outside the European Union.

6. EXERCISING RIGHTS

Your consent for processing your personal data will be specifically requested through checking boxes on the forms that are essential requirements for completing the registration of the application.

Once the data has been provided, the data subject may exercise their rights as such including access (learning what personal data are processed), rectification (asking for incorrect data to be corrected), erasure (deleting the data) and data portability and to restrict or object to their processing with respect to the data stored in our files.

You can exercise these rights free of charge by writing to: Estación de Esquí Baqueira Beret. Oficinas Cota 1500. Baqueira-Naut Aran, 25598 (Lleida), indicating “Personal data protection management” and specifying your data, giving proof of your identity and stating the reasons for your request. You may also exercise your rights by emailing protecciondatos@baqueira.es.

BAQUEIRAPASS GENERAL TERMS AND CONDITIONS OF PURCHASE AND USE

  1. The BaqueiraPASS allows you to top-up Resort access passes online, whether for the entire season or consecutive days (from 1 to 7 days).
  2. Remember that you must always carry the physical BaqueiraPASS with a valid and current top-up to access the resort ski lifts.
  3. The BaqueiraPASS application is online and the processing fee is €10. It is valid for a minimum of 3 seasons.
    Copies of the BaqueiraPASS which are requested if the original is lost, stolen, modified or broken will cost 10 euros for support and administration fees.
  4. The BaqueiraPASS application requires a link to a valid and unique email address per holder. IT IS NOT POSSIBLE TO REQUEST MORE THAN ONE ADULT BaqueiraPASS LINKED TO THE SAME EMAIL ADDRESS. Minors will be linked to the email address of the responsible adult who requests the BaqueiraPASS in their name.
  5. Baqueira Beret will send an email address to the holder to confirm their application and provide their consent with regards to the personal data protection policy and the BaqueiraPASS terms and conditions of purchase and use. The pass cannot be issued without this consent.
  6. Once the BaqueiraPASS application has been submitted, if all details and the photograph are correct (*), you will receive the BaqueiraPASS at your address within approximately 5 working days (it can only be sent within the country, except the Canary Islands, Vall d’Aran and Valls d’Àneu, and France. Any other BaqueiraPASS must be collected from the Resort’s Baqueira 1500 offices) 
    (*) The photograph submitted with the application must be suitable for facial recognition at the Resort access control points, therefore it must comply with the requirements indicated in the application form. No BaqueiraPASS will be processed without a valid photo, which could delay the BaqueiraPASS application process.
  7. The purchase of a BaqueiraPASS at a reduced price due to age will require the presentation of a National ID, passport or official document with a photograph which provides proof of age. The use of a BaqueiraPASS or other pass which is unsuitable for the holder’s age will make it invalid.
  8. Purchase of a BaqueiraPASS does NOT guarantee priority for top-ups with regards to other users or products.  Top-up rejection will NOT entitle the holder to any refund.
  9. The BaqueiraPASS IS NOT COMPATIBLE with the special BEGINNER, VISITOR AND AFTERNOON rates. To take advantage of these special rates, you must visit the Resort booths.
  10. The BaqueiraPASS is personal and non-transferable. Use by a person other than the holder will result in it being blocked, and double the booth price for a daily pass must be paid to reactivate it. Resort staff can ask the BaqueiraPASS holder to identify themselves with their official identity document. Access can be denied to the ski lift if their identity cannot be proven.
  11. Ski lift access is controlled via wireless scanning; to avoid errors and interference, only one BaqueiraPASS should be used when accessing the ski lift. If a person has more than one BaqueiraPASS, the others will be removed, and they can be collected from the Baqueira 1500 information offices at the end of the skiing day (5pm).
  12. Before using our facilities, please ensure that you have the knowledge and physical ability required to use them safely, for you and others. Learn about the different types of ski lift and how they are used. Observe staff instructions at the facilities and read the information signs.
  13. The BaqueiraPASS DOES NOT INCLUDE SKIING ACCIDENT INSURANCE.
  14. At the end of the winter season, copies of the BaqueiraPASS will not be made.

BAQUEIRAPASS SEASON TOP-UP TERMS AND CONDITIONS OF PURCHASE AND USE

  1. The season top-up is a transport ticket which allows the holder to access facilities open to the public via the Resort in accordance with the terms and conditions determined in each case. The length of the season is unspecified. The dates indicated by the Resort are for guidance purposes only, and they will be determined by the presence/lack of snow, technical and organisational matters and, where applicable, force majeure. A shorter or longer season will not entitle users to any refund, reimbursement or exchange.
  2. Throughout the season, and especially for weather reasons but also technical, economic or organisational reasons and due to force majeure, the Resort might close facilities, areas or zones. This will not entitle users to any refund.
  3. It is personal and non-transferable. The holder must top-up via their user account.
  4. The top-up price includes VAT and SOV (compulsory travellers’ insurance) as it is a transport ticket.
  5. The top-up price does NOT INCLUDE SKIING ACCIDENT INSURANCE, which should be taken out separately.
  6. Once purchased, the top-up is non-refundable and non-exchangeable.
  7. The season top-up does not guarantee priority access to the Resort if there is a capacity limit. If a capacity limit is required, the Resort will determine the terms and conditions of access for the season BaqueiraPASS in each case, and it can refuse access on occasional days. This situation will NOT entitle the holder to any refund.

  8. To access the Resort facilities, it is necessary to present a validly topped-up BaqueiraPASS to be checked by Resort staff.
  9. The purchase and use of the BaqueiraPASS with a season top-up requires the holder to read and accept the applicable regulations in force regarding cable transport (Law 12/2002 of 14 June, regarding Catalonia cable transport, and related Decree 152/2010 (specifically article 51), as well as the Rules of Use for ski lifts and slopes approved by the Catalonia Government's Transport Department dated 10 November 1987), the ATUDEM regulation and its appendices (particularly the FIS Regulations), and the specific terms and conditions established by Baqueira Beret. Users must always act in accordance with these regulations and terms and conditions, and particularly the instructions given by Resort staff. Ensure that children for which you are responsible read, understand and act in accordance with these regulations and guidelines.
  10. If the BaqueiraPASS is lost or forgotten, the Resort will provide the holder with a maximum of 2 daily passes per season. Where applicable, they must pay the general booth price on the third and successive occasions.

The daily pass service if you forget your pass is not valid for access to the ski lift in summer. In this instance, a lift pass must be purchased.

BAQUEIRAPASS WEEKDAY TOP-UP TERMS AND CONDITIONS OF PURCHASE AND USE

  1. The WEEKDAY top-up is a transport ticket which allows the holder to access facilities open to the public via the Resort in accordance with the terms and conditions applicable to this rate and those determined in each case. The length of the season is unspecified. The season dates indicated by the Resort are for guidance purposes only, and they will be determined by the presence/lack of snow, technical and organisational matters and, where applicable, force majeure. A shorter or longer season will not entitle users to any refund, reimbursement or exchange.
  2. The WEEKDAY top-up allows access to the Resort in accordance with a calendar with pre-determined valid days.
    This top-up method is incompatible with the daily top-up method, therefore to ski on days outside the established calendar, it will be necessary to purchase another pass.
  3. Throughout the season, and especially for weather reasons but also technical, economic or organisational reasons and due to force majeure, the Resort might close facilities, areas or zones. This will not entitle users to any refund.
  4. It is personal and non-transferable. The holder must top-up via their user account.
  5. The top-up price includes VAT and SOV (compulsory travellers’ insurance) as it is a transport ticket.
  6. The top-up price does NOT INCLUDE SKIING ACCIDENT INSURANCE, which should be taken out separately.
  7. Once purchased, the top-up is non-refundable and non-exchangeable.
  8. The season top-up does not guarantee priority access to the Resort if there is a capacity limit. If a capacity limit is required, the Resort will determine the terms and conditions of access for the season BaqueiraPASS in each case, and it can refuse access on occasional days. This situation will NOT entitle the holder to any refund.

  9. To access the Resort facilities, it is necessary to present a duly topped-up BaqueiraPASS to be checked by Resort staff.
  10. The purchase and use of the BaqueiraPASS with a season top-up requires the holder to read and accept the applicable regulations in force regarding cable transport (Law 12/2002 of 14 June, regarding Catalonia cable transport, and related Decree 152/2010 (specifically article 51), as well as the Rules of Use for ski lifts and slopes approved by the Catalonia Government's Transport Department dated 10 November 1987), the ATUDEM regulation and its appendices (particularly the FIS Regulations), and the specific terms and conditions established by Baqueira Beret. Users must always act in accordance with these regulations and terms and conditions, and particularly the instructions given by Resort staff. Ensure that children for which you are responsible read, understand and act in accordance with these regulations and guidelines.
  11. A BaqueiraPASS holder with a WEEKDAY top-up can request a free daily pass if they forget or lose their card for a maximum of two days. If a daily pass is requested due to forgetting the pass for a third time, the full booth price must be paid.
    If the BaqueiraPASS is lost or forgotten, the Resort will provide the holder with a maximum of 2 daily passes per season. Where applicable, they must pay the general booth price on the third and successive occasions.

BAQUEIRAPASS DAILY TOP-UP TERMS AND CONDITIONS OF PURCHASE AND USE

  1. The BaqueiraPASS can be topped up from 1 to 7 days, always CONSECUTIVE. The top-up is a transport ticket which allows the holder to access facilities open to the public via the Resort in accordance with the terms and conditions determined in each case. The length of the season is unspecified. The season dates indicated by the Resort are for guidance purposes only, and they will be determined by the presence/lack of snow, technical and organisational matters and, where applicable, force majeure.
    It must be taken into account that the facilities which are open can vary throughout the day, and from one day to the next, for weather reasons, particularly wind, and for technical or organisational reasons. This situation will not entitle users to any total or partial refund. If you are unsure, we suggest purchasing passes from day to day, since whilst the longer-term passes provide a discount on the purchase price, they are affected by changes in time and the number of facilities which are open.
  2. Throughout the season, and especially for weather reasons but also technical, economic or organisational reasons and due to force majeure, the Resort might close facilities, areas or zones. This will not entitle users to any refund.
  3. It is personal and non-transferable. Use by a person other than the holder will result in the withdrawal and cancellation of the BaqueiraPASS.
  4. The top-up price includes VAT and SOV (compulsory travellers’ insurance) as it is a transport ticket.
  5. The top-up price DOES NOT INCLUDE SKIING ACCIDENT INSURANCE, which can be purchased when paying for the top-up. Once the purchase process is complete, it is not possible to then add insurance.
  6. If capacity is limited, in each instance the Resort will determine the terms and conditions of access. It can refuse access on occasional days, in which case the Resort will refund the amount for days when access was not allowed.
  7. To access the Resort facilities, it is necessary to present a duly topped-up physical BaqueiraPASS to be checked by Resort staff.
  8. The purchase and use of the BaqueiraPASS with a daily top-up requires the holder to read and accept the applicable regulations in force regarding cable transport (Law 12/2002 of 14 June, regarding Catalonia cable transport, and related Decree 152/2010 (specifically article 51), as well as the Rules of Use for ski lifts and slopes approved by the Catalonia Government's Transport Department dated 10 November 1987), the ATUDEM regulation and its appendices (particularly the FIS Regulations), and the specific terms and conditions established by Baqueira Beret. Users must always act in accordance with these regulations and terms and conditions, and particularly the instructions given by Resort staff. Ensure that children for which you are responsible read, understand and act in accordance with these regulations and guidelines.
  9. If the BaqueiraPASS is forgotten or lost, a pass must be purchased at the booth at the regular price. If the BaqueiraPASS is forgotten with a valid top-up, a free pass will only be provided if the top-up took place 24 hours before use of the service (only 1 pass will be provided on 2 occasions per season, on the third and successive occasions, a new pass must be purchased at the general booth price).
